EXP Topco, LLC—the owner of the trademarks relating to the iconic Express clothing brand—sued CaaStle in New York Supreme Court on April 8, asserting claims for breach of contract, trademark infringement, and unjust enrichment, arising out of CaaStle’s use of EXP Topco, LLC’s intellectual property in connection with its Express Style Trial subscription service.
The article details the chaos surrounding CaaStle and Hunsicker, who has been accused of providing doctored financial statements to investors and leaving the company with “a severe and immediate liquidity problem.” EXP Topco, LLC was the first counterparty to sue CaaStle after the allegations became public.
